Parental relocation is one of the most difficult, highly contested, stressful areas of family law.  Rarely do you have one parent willing to agree to let the other parent take the child(ren) to a new location which is usually out of state.  

When a parent is requesting a move that substantially changes the geographical location of a child to his or her other parent, they will have to establish numerous different factors before a court will allow them to do so.  If a Parenting Plan is already in place, it makes this process even more difficult by adding additional factors.  

It is important to understand that the court cannot prevent a parent from moving if they choose to.  However, the court does have jurisdiction over the child(ren) and therefore determines if the child(ren) will move with that parent.  Relocation cases often involve the creation of new parenting plans.  

With relocation cases, time is usually of the essence and therefore these cases are supposed to take precedent on the court’s docket.  However, it is possible that you may be in a state of flux for months prior to receiving a decision from the court.  When initiating a relocation case, you usually want to request the relocation as far ahead of your desired move as possible.
